These terms of use govern the use of the Vitalstat Lume website and iOS app. By accessing the website or using the app, you accept these terms.

1. Provider

The provider of the website and app is Nicklas Matthias Wehling, c/o IP-Management #9523, Ludwig-Erhard-Straße 18, 20459 Hamburg, Germany.

2. Service description

Lume is an app for couples for private use. The app is intended to organise and display shared content, prompts, games, questions, wishes, consent-related elements, and other intimate or relationship-related content between connected devices.

Except where mandatory law requires otherwise, there is no entitlement to a specific feature set, a specific level of availability, or the continued existence of individual features.

3. Age requirement and personal responsibility

The app is intended exclusively for adults. By using it, you confirm that you are at least 18 years old and allowed under the law applicable to you to access content of this kind.

The app does not provide medical, psychological, therapeutic, or legal advice. Any actions inspired by the app are undertaken solely voluntarily and at the users' own responsibility.

4. Consent, safety, and limits of use

All interactions between users must be consensual, voluntary, and lawful. You are solely responsible for respecting boundaries, consent, and the well-being of all people involved.

The app may not be used for unlawful, coercive, harassing, exploitative, or otherwise inappropriate purposes.

5. Account and access

Certain functions require technical account management via Firebase. You are responsible for keeping access credentials confidential and for protecting your device appropriately.

We may restrict or terminate access where there are concrete indications of misuse, security risks, or breaches of these terms.

6. User content

To the extent that you create or sync your own content within the app, such as wishes, answers, custom decks, custom evenings, or other text, the rights to that content generally remain with you.

You grant us the rights of use required to operate the app, to the extent technically necessary to store, sync, display the content on connected devices, and delete it again on your request.

You must not upload content that infringes third-party rights or violates applicable law.

7. Payments and in-app purchases

Paid features, subscriptions, or lifetime unlocks, where offered, are processed through Apple In-App Purchases. Apple's terms take precedence for billing, withdrawal rights where applicable, refunds, and payment administration.

Unlocking paid features within the app may depend on technically transmitted purchase or status information.

8. Availability and changes

We aim to provide the service with as little disruption as possible, but we do not owe uninterrupted availability. Maintenance, security measures, further development, or technical issues may lead to restrictions.

We may amend content, features, and these terms where we have a legitimate interest in doing so, in particular for legal, security-related, technical, or product-related reasons.

9. Liability

We are fully liable in cases of intent and gross negligence and in the event of injury to life, body, or health.

In cases of slight negligence, we are liable only for the breach of essential contractual obligations; in that case liability is limited to the typical foreseeable damage.

Mandatory statutory rights of liability, in particular under product liability law, remain unaffected.

10. Term, termination, and deletion

You may stop using the app at any time and delete your account using the available functions.

We may restrict or terminate use for good cause, in particular in cases of serious or repeated breaches of these terms or security-relevant incidents.

11. Privacy

Information on the processing of personal data can be found in the privacy policy on this website. The privacy policy is not itself a consent form; it describes the actual processing activities and your rights.

12. Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions of the country of your habitual residence provide otherwise.

13. Consumer dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
